Tasted Terms of Service

These Terms of Service (“Terms”) are an agreement between you and Mysite.ai, Inc. (“Tasted”, “we”, “us”), a Delaware corporation, and govern your use of the Tasted mobile application and related services (the “Service”). By using the Service, you agree to these Terms. If you do not agree, do not use the Service.

1. What Tasted is

Tasted is a rewards application. It shows you restaurants that participate in our cashback programme, and pays you cashback when you visit one and prove the visit.

Tasted is not a bank and is not a financial adviser. We do not hold deposits, and we never move money in or out of your bank account. Where you connect a bank account, our access is read-only.

2. Eligibility and your account

You must be at least 18 years old and resident in the United States to use the Service. You sign in with your mobile phone number, and you are responsible for keeping access to that number secure and for activity that happens under your account.

One person, one account. Do not create an account on behalf of anyone else.

3. Cashback

Each participating restaurant has a stated cashback amount and, where applicable, a minimum spend. To earn cashback you must:

Claim the offer in the app before your visit, which locks the amount;
Visit the restaurant within the window shown in the app; and
Prove the visit, either by submitting a photograph of your receipt or by having connected a bank account in which we can recognise the purchase.

Proof is required. A claim without proof earns nothing. We review receipts, and we may decline a claim where the receipt does not match the restaurant, date, or amount, or where we reasonably believe a claim is duplicated or fabricated.

Cashback accrues as a balance in the app. We may set a minimum balance before it can be paid out, and we may change offers, amounts, and programme rules at any time. Changes do not affect an offer you have already claimed.

4. Connecting a bank account

Connecting a bank account is optional. If you choose to, you authorise us and our service provider Plaid Inc. to access transaction and account information from that account on your behalf, as described in our Privacy Policy. Your use of Plaid is also subject to Plaid’s End User Privacy Policy.

You may disconnect at any time in the app under Settings → Bank, and we will delete the data obtained from that account.

5. Content you post

You keep ownership of the photos, notes, ratings, and comments you post. You grant us a non-exclusive, worldwide, royalty-free licence to host, store, reproduce, and display that content for the purpose of operating and promoting the Service.

Only post content you have the right to post. Do not post anything unlawful, misleading, hateful, or infringing. We may remove content and suspend accounts that breach these Terms.

6. Acceptable use

You agree not to:

Submit a false, altered, duplicated, or otherwise fraudulent claim;
Use another person’s account, receipt, or bank account;
Interfere with, probe, or attempt to gain unauthorised access to the Service;
Scrape or extract data from the Service by automated means; or
Use the Service for any unlawful purpose.

Fraudulent claims may result in forfeiture of your balance and termination of your account.

7. Restaurants are independent

Participating restaurants are independent businesses. We do not operate them and are not responsible for the food, service, hygiene, pricing, or anything else about your visit. Information we show about a restaurant, including data from third-party sources, may be incomplete or out of date.

8. Changes and termination

We may modify or discontinue the Service, or any part of it, at any time. We may suspend or terminate your account if you breach these Terms or where required by law. You may stop using the Service and request deletion of your account at any time by emailing support@jointasted.com.

We may update these Terms. When we do, we will change the “Last updated” date above, and for material changes we will provide additional notice. Continuing to use the Service after a change means you accept the updated Terms.

9. Disclaimers

The Service is provided “as is” and “as available”, without warranties of any kind, express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted or error-free.

10. Limitation of liability

To the maximum extent permitted by law, Mysite.ai, Inc. and its officers, employees, and agents will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits or data, arising out of your use of the Service. Our total liability for any claim relating to the Service will not exceed the greater of the cashback balance in your account at the time the claim arose, or one hundred US dollars (USD 100).

Some jurisdictions do not allow certain limitations, so parts of this section may not apply to you.

11. Governing law

These Terms are governed by the laws of the State of Delaware, without regard to its conflict-of-laws rules. You and we agree to the exclusive jurisdiction of the state and federal courts located in Delaware.
